1. Overview

AXIS Real Estate Group ("we," "us," or "our") operates the website at axisrealestategroup.com and respects the intellectual property rights of others and expects users of our Website ("Website") to do the same. In accordance with the Digital Millennium Copyright Act of 1998, 17 U.S.C. 512 ("DMCA"), we will respond promptly to claims of copyright infringement committed using our Website.

We claim protection under both Section 512(c) (information stored at the direction of users) and Section 512(d) (information location tools) of the DMCA for content displayed on our Website, including property listings sourced through Internet Data Exchange (IDX) programs.

2. Property Listing Content

Our Website displays property listings provided through Internet Data Exchange (IDX) programs and Multiple Listing Services (MLS). Listing photographs, descriptions, and related media are provided by participating brokerages and MLS organizations. The copyright ownership chain for MLS listing photos typically flows from the original photographer to the listing agent or seller, then to the MLS, and is then redistributed through IDX to authorized participants such as our Website.

If you believe that any listing content on our Website infringes your copyright, please follow the notification procedures described below. For concerns related specifically to MLS data accuracy or listing information disputes, we recommend first contacting the listing brokerage or the relevant MLS organization directly, as they are the original source of the content.

3. Filing a DMCA Takedown Notice

If you believe that content on our Website infringes your copyright, please submit a written notification containing all of the following information to our designated DMCA agent identified in Section 4:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works;
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., the URL of the page containing the material);
  • Your contact information, including your name, address, telephone number, and email address;
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

The notification must be in writing (electronic or physical) and must contain all six elements listed above to be effective under 17 U.S.C. 512(c)(3). A notification that does not substantially comply with these requirements may not be considered in determining whether we have actual knowledge of infringing material.

5. Response to Takedown Notices

Upon receipt of a valid DMCA takedown notice that substantially complies with the requirements of 17 U.S.C. 512(c)(3), we will act expeditiously, typically within 3 to 5 business days, to remove or disable access to the allegedly infringing material. We will also make a good-faith attempt to notify the user who posted the material, if applicable.

6. Counter-Notification

If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may submit a written counter-notification to our designated DMCA agent containing the following:

  • Your physical or electronic signature;
  • Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled;
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled;
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the Middle District of Florida if your address is outside the United States), and that you will accept service of process from the person who provided the original notification or an agent of such person.

The counter-notification must be in writing and must contain all four elements listed above. Upon receipt of a valid counter-notification, we will promptly provide the original complainant with a copy of the counter-notification. We may restore the removed content not less than 10, nor more than 14, business days after receiving the counter-notification, unless the copyright owner files a court action seeking a restraining order against the content provider.

7. Repeat Infringers

In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts or access of users who are deemed to be repeat infringers. A repeat infringer is any user who has been the subject of two or more valid DMCA takedown notices. We may also limit access to the Website and terminate the accounts of any users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.

8. Good Faith Notice

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorney's fees. If you are not sure whether material on our Website infringes your copyright, we suggest that you consult with an attorney before filing a notification or counter-notification.
